Terms of Service
Please read these terms and conditions carefully before creating your merchant account or using OurMenu services.
1Acceptance of Agreement
By registering for an OurMenu merchant account, subscribing to any service plan, or integrating OurMenu QR ordering systems at your dining establishment, you agree to be bound by these Terms of Service. If you do not agree to all terms herein, you must refrain from registering or using our platform.
2Merchant Eligibility & Account Security
To establish an account, you must represent a legitimate food, beverage, or hospitality venue and possess legal authority to bind that business. You are responsible for safeguarding your administrative account credentials and for all activities conducted under your subdomain and merchant dashboard.
3Subscription Plans, Billing & Renewals
- Billing Cycles: Subscriptions are billed on an automated recurring basis, either monthly or annually, in advance of the service period.
- Promotions & Discounts: Valid promotional coupon codes (such as WELCOME50) apply only to the specified introductory billing cycle and do not alter subsequent renewal rates.
- Plan Upgrades: Upgrades take effect immediately upon payment of the prorated price difference.
- Taxes: All fees are exclusive of statutory taxes (such as GST or VAT), which are calculated and collected based on the jurisdiction of your restaurant establishment.
4Cancellation & Refund Policy
Merchants may cancel their recurring subscription at any time directly through the merchant control panel or by submitting a written notice to support@ourmenu.app.
New merchants who are unsatisfied with their first paid subscription may request a full refund within 14 calendar days of initial purchase. Following this 14-day window, subscriptions continue until the end of the paid billing cycle without mid-term prorated refunds.
5Restaurant Menu Content & Intellectual Property
You retain complete intellectual property ownership over your menu item descriptions, food images, restaurant logos, branding assets, and pricing data uploaded to the platform. By uploading content, you grant OurMenu a non-exclusive license solely to host, render, and display your digital menu to diners.
Merchants are solely responsible for ensuring that all food allergen warnings, price declarations, dietary tags (e.g., vegetarian, vegan, gluten-free), and alcohol licensing comply with local food safety regulations.
6Diner Transactions & Food Quality
OurMenu provides the software interface connecting diners with restaurant kitchens. All food preparation, culinary quality, hygienic handling, order fulfillment, and direct dispute resolution with diners remain the exclusive responsibility of the merchant restaurant.
7Service Availability & SLAs
We strive to maintain 99.9% uptime for digital QR menus and kitchen ordering pipelines. Scheduled maintenance is performed during off-peak hours whenever practical, with advance notification provided through the merchant dashboard.
8Limitation of Liability
To the maximum extent permitted by applicable law, OurMenu and its affiliates shall not be liable for indirect, incidental, special, or consequential damages, including loss of restaurant revenue or profits, resulting from internet outages, hardware failures, or diner misbehavior.
